dc.description.abstractLors des procès médicaux de Nuremberg, l’accusation avait motivé la création d’un comité ad hoc chargé d’émettre un avis sur des expérimentations humaines réalisées aux États-Unis en temps de guerre sur des prisonniers. Précisément, ce qui constituait un chef d’accusation contre Karl Brandt et ses collègues. Ce comité est le précurseur des Comités indépendants, auxquels la déclaration d’Helsinki donne un rôle dans l’analyse de l’éthique d’un projet de recherche sur l’homme. À partir de 1980, les pays industrialisés vont introduire dans leur législation ayant trait aux essais cliniques une structure voisine, IRB (institutional review board) aux États-Unis d’Amérique, « Comités d’éthique » ailleurs, comité de protections des personnes en France. Mais, à ce moment là, en dépit des mots trompeurs, on passera de l’éthique au droit, de règles de conduite à l’intention des chercheurs à des règles juridiques organisant des rapports entre les promoteurs, les investigateurs et les personnes se prêtant à des recherches biomédicales, ce qui n’est certes pas la même chose.fr
dc.description.abstractDuring the Nuremberg trials, the accusation prompted the creation of an ad hoc committee to advise on human experiments carried out on prisoners during wartime in the USA. Precisely a charge that had been brought against Karl Brandt and his colleagues. This committee was the forerunner of the Independent Committees, to which the Declaration of Helsinki assigned a role in analysing the ethics of research projects in humans. From 1980 onwards, in industrialised countries, the legislation regarding clinical trials began to incorporate similar structures, IRBs in the United States of America, Ethics Committees elsewhere, and the “Committee for the Protection of Persons” in France. However, at that time, in spite of the misleading words, we went from ethics to law, from rules of conduct intended for researchers to legal regulations organising relations between sponsors, investigators and persons participating in biomedical research, which is not the same thing.en
